The Massachusetts attorney general has not yet said if she’ll appeal a court ruling allowing a new natural gas pipeline to run through Otis State Forest. Now one Berkshire County state representative would like the legislature to take action.
A judge this week granted the company Kinder Morgan an injunction, saying federal approval for the pipeline trumps Article 97 of the Massachusetts Constitution. That law protects state-owned conservation land, unless the legislature okays other uses for the property, which hasn’t happened yet in this case.
State Rep. Smitty Pignatelli says a vote by lawmakers could strengthen the state’s case.
“It would diminish out opportunity to have a legitimate appeal when Kinder Morgan says, ‘We filed the bill. The legislature ignored us. They didn’t take action,'” Pignatelli says. “I think we should take action. It shows that we are committed to killing this project.”
The earliest Kinder Morgan could begin work on the pipeline is late July.
